A 15 year old can go to jail in the Philippines.

Anyone under 15 years of age would likely not go to Jail in the Philippines unless they committed a serious enough crime but a 15 year old and above can more easily go to Jail for a crime they committed.

Children in jail in the Philippines is a significant problem.

According to Amnesty International, over 50,000 children in the Philippines have been arrested and detained since 1995.

Torture, rape and other forms of cruel and inhumane treatment are a part of everyday life for those children while they're incarcerated.

The current Juvenile Justice and Welfare Law, which sets the minimum age of criminal responsibility at 15, already holds children in conflict with the law accountable for their actions.

It provides them with rehabilitation programs using the framework of restorative, not punitive justice.

Under RA 9344, the minimum age of criminal liability is 15 years old.

This means that those within the age of 15 to 18 years old may be detained in youth centers and go through rehabilitation programs while those under 15 years old are exempted from criminal liability but must undergo intervention.

Children, some as young as five years old, are committing some of the most brazen crimes in the Philippines, from running drug dens to sexual assault.

And many are getting off scot-free.

Offenders aged below 15 are spared trial and jail in this country.
