Brigand in criminal law is the criminal act and illegal act of blunder or highway robbery.

In the U.S., the act of brigandage was found in certain unsettled parts, especially in the northern regions.

The act of brigandage is usually committed by armed bands, often associated with forests or mountain regions.

Brigandage is the life and practice of highway robbery and plunder.

It is practiced by a brigand, a person who usually lives in a gang and lives by pillage and robbery.

In law the robbery in band is committed when four (4) or more malefactors take part in the robbery.

Basically a band is 3 or more people so when 3 or more people commit a robbery then it's robbery in band.

Under Article 294 (5) in relation to Article 295, and Article 296 of the Revised Penal Code, robbery in band is committed when four (4) or more malefactors take part in the robbery.

When more than three armed persons form a band of robbers for the purpose of committing robbery in the highway, or kidnapping persons for the purpose of extortion or to obtain ransom or for any other purpose to be attained by means of force and violence, they shall be deemed highway robbers or brigands

By a band. - Whenever more than three armed malefactors shall have acted together in the commission of an offense.

Examples of robbery.

When a person who steals a wallet out of a woman's purse that's hanging on the back of her restaurant seat has stolen from the victim's presence.

A person who locks a store clerk in the breakroom in order to steal from the cash register also takes something from the victim's presence.

When someone enters a bank and demands money from the teller with or without a gun.

However when the robber uses a gun or weapon then it becomes armed robbery.

For example armed robbery, in criminal law, aggravated form of theft that involves the use of a lethal weapon to perpetrate violence or the threat of violence (intimidation) against a victim.
