Utah is the state that has the highest legal alcohol limit.

Utah legal alcohol limit was 0.8 but as of 2018 they have lowered the legal alcohol limit to 0.5 so they have become the strictest.

There's not other state that has the highest alcohol limit but some other states may still have the legal alcohol limit to being 0.8

The state that has the most DUI arrests is South Dakota.

South Dakota has the most DUI arrests out of all the other states and they have arrested about 938 people out of 100 thousand people.

That is 100 DUI arrests than North Dakota.

DUI is a serious thing and I think it should be punished more severely because I know innocent people who have gotten killed in a wreck caused by a drunk driver and the drunk driver didn't get injured while the non drunk drivers got killed.

A flask that has alcohol in it is considered an open container.

However if the flask has not had any alcohol in it then it's not considered an open container but once you put alcohol in it then it's considered to be an open container.

So make sure to not have a flask with alcohol in it inside your vehicle.

The law considers open containers when it comes to alcohol to be bottles of wine, beer, spirits or other alcohol that has had the seal broken.

Once the seal is broken then it's an open container.

An open container charge does not go on your driving record unless you're the driver who has been charged with the open container.

If your the passenger and charged with an open container then it will not usually go on your driving record.

However if you're the driver and got charged with an open container charge then it usually does go on your drivers record.

There are some states however that do not have open container laws such as Arkansas, West Virginia, Virginia, Delaware, Connecticut and Missouri.

The penalty for an open container is usually just a fine which is around $1,000.00

If you're not drunk then you may just get a ticket and an order to appear in court and if you don't appear in court then a warrant can be put out for your arrest.

If it's your first offense for the open container then you likely will just get the fine but if it's your second offense or you're drunk with the open container then you may get 6 months to a year in jail as well as the $1,000.00 fine.

Most states make it illegal for passengers in a car or other vehicle to consume or drink alcohol as a passenger.

Even though the passenger is not the one driving it's still illegal for the passenger to drink alcohol because the driver could also be drinking although most times they are not.

So most states do make it illegal for the passengers to consume alcohol.

However the passengers or passenger can be drunk and riding with a sober driver which is legal but if you get pulled over with a drunk passenger then they may want to do a sober test on the driver as well to ensure you're not drunk.

If you're not drunk or have not drank any alcohol then submitting to the test is what you should do.

If caught as a passenger drinking then the driver and passenger can be charged with an open container charge.

The only exception to a passenger in a car drinking is in a Limo.

Yes Limos can serve alcohol to the passengers.

However to be able to serve alcohol in a limo you need and alcohol serving license along with your license for the Limo.

The reason Limos can serve alcohol to passengers in the limo is there's a window in the limo that separates the drivers compartment from the passengers.

So the passengers can drink alcohol while the limo driver does the driving.

The people in the limo can get drunk as long as the limo driver does not drink any alcohol and any professional limo driver would not drink alcohol while driving.

I've drank alcohol in a limo before for a party and it was legal to do so.
