Capital Murder is defined as murder with an escalated version of the murder and commission of another crime such as kidnapping.

If you kidnap someone and kill them that would be Capital Murder or if you kidnapped someone's kids and killed their mother and father or one or the other then that would be Capital Murder.

Capital Murder is also when a person intentionally commits the murder in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat under Section 22.07.

Capital Murder makes someone eligible for the death penalty and there's no parole for a person who has been charged with and convicted of Capital Murder.

If you're charged and convicted of Capital Murder you will get either life in prison or the death penalty or both.
