If a jail is legally gonna hold you and you cannot make bail you can be held in jail for at least 36 to 48 hours before seeing a judge.

Most times a judge has to see you within 36 to 48 hours and let you know what you're being charged with or the jail must release you from custody.

If you can bail out of jail and have the money to do so then it would be best to bail out of jail unless you know that you're gonna serve jail time.

If you're sure you're gonna serve jail time then it might be best to just stay in jail and wait because that time in jail will count towards your other jail time and you'll be released sooner.

But if you're unsure you're gonna serve any jail time then if you are allowed bail then you should use the bail and get out of jail until the court date.
