The law on empty alcohol bottles can vary from state to state.
In most states carrying an empty alcohol bottle or beer can that is empty in your vehicle could be seen as an open container.
Having the beer bottle or beer can or other alcohol container in your vehicle would not look good to a police officer when they pull you over.
The police officer will assume that you've been drinking the alcohol while driving because there really is no other good reason to carry an empty alcohol bottle in the cab of your car or other vehicle.
So that could get you an open container ticket and they will likely check to see if you're drunk or over the limit to drive.
But having alcohol bottles say in your trunk or in the back of your truck that are empty is usually not illegal.
I've carried empty alcohol and beer bottles in the bed of my truck after a party and I was not drunk nor did the police suspect I was drunk and I certainly didn't drink all that beer but we just threw the beer bottles into the bed of my truck as we were sitting on the tailgate.
I was pulled over for a tail light being out and the police saw the empty alcohol bottles and just said we must have had a good time at a party.
I told him yes and he didn't suspect I was drunk because I wasn't.
If you have beer bottles in your vehicle though on the inside you need to throw them out so that you don't potentially get into trouble.
