It can depend on the state you reside in but in most states you have to be at least 18 years old to invest in penny stocks or any other stocks and bonds.
In some states you can't invest in penny stocks or other stocks until you're 21 years of age.
Check with your local laws to be sure but as long as you're 18 or above you should be able to invest in penny stocks.
