When a drunk driver kills someone then they will be arrested for DUI as well as be charged with manslaughter.

DUI is bad enough but when you're drunk and kill someone or more than one person you get a more serious charge and can face prison time.

A person convicted of DUI as well as manslaughter may face up to 10 years or even longer in prison depending on if it's your first offense, second offense, third offense etc.

If it's not your first offense of driving drunk or not your first DUI then the penalties will be more severe.

Manslaughter is the crime of killing a human being without malice aforethought, or otherwise in circumstances not amounting to murder.

If convicted of involuntary manslaughter the penalty is up to 10 years in prison and for voluntary manslaughter the prison term is up to 15 years in prison.

Personally I don't believe that is enough prison time for someone who drives drunk and kills someone.

And although the person didn't have an intention to kill someone while drunk driving the person did have an intention of drinking and getting drunk.

Then the drunk person got behind the wheel and killed someone and it's usually never the drunk driver that gets injured or killed but instead some innocent person or their family.

The drunk drivers typically walk away without harm or death while the non drunk drivers most often get killed.
