Most personal injury cases do eventually go to trial if there is enough evidence to show that someone really was at fault and that there can be a case for it.

During personal injury cases the plaintiff's attorney (that is, the lawyer for the injured party) often works on contingency basis.

This basically means that the plaintiff is not usually responsible for a big cost of going to court unless you win the case.

So sometimes the case for the personal injury lawsuit may go to trial but sometimes it may be settled without a trial.

But do be prepared to go into court on a trial just in case the judge decides you need to have a trial to win the actual personal injury case.
