A hospital cannot turn you away if you owe them money if you have a medical emergency.

Under the Emergency Medical Treatment and Active Labor Act or EMTALA, hospitals must treat you and not turn you away if you're having a medical emergency or are in active labor and about to give birth.

The Emergency Medical Treatment and Active Labor Act is a federal law that requires hospitals to screen you and stabilize you and pursue collection of payment and bills later.

Even if you have no money or no health insurance and cannot pay the hospital, the hospital must treat you in emergencies.

Hospitals, must provide screening and stabilizing treatment, including baby delivery services before discussing payment, but the hospital also can follow up with billing and debt collection after you're stable or have been discharged.

Any hospital with an emergency room that accepts Medicare payments, must follow the Emergency Medical Treatment and Active Labor Act law.

So if you have a medical emergency or are in active labor and cannot pay the hospital, you should still seek treatment, if you're having a medical emergency as they cannot turn you away.

You can pay what you can pay them, even if it's $10.00 a month, $20.00 a month or so.

But you can still get treatment from a hospital if you owe them money and have no insurance.

Also even if you've been trespassed from a particular hospital, you can legally go back to that hospital you've been trespassed from as long as you're having a genuine medical emergency and need treatment.

The EMTALA law also requires a hospital to provide emergency screening and stabilizing treatment, which overrides a trespass order because they can't deny emergency care based on your status.

Although you have to have an actual emergency and not just trying to get regular care to avoid the trespass.

If you show up at the hospital that you've been trespassed from and don't have a medical emergency then you can be arrested and they can refuse treatment.
