Is it illegal to remove Survey Stakes?

I had a survey done on my property yesterday. Well today when I got home the survey stakes were missing. One of my neighbors removed them?

I called the police but they said they couldn't do anything?

I thought it was illegal to remove Survey Stakes?

It is illegal. But most likely the person won't arrested for it. I've heard it's more of a civil matter but in some rare cases the person can get 90 days in jail. But it's very unlikely and depends on your state laws.

In most states it's just a civil matter and a misdemeanor at most.
