How long before I can evict someone who is in breach of the land contract?

I sold a house through a land contract and the buyer has missed 2 payments already.

How long do I have to wait before I can evict the tenant for being behind on payments through a land contract?

Since the tenant is a buyer and not a standard tenant the process to evict this tenant for a rent to own or land contract will differ.

You actually will have to start a foreclosure process and not just an eviction process.

The time to be able to get them foreclosed on could take 6 months to a year or even sometimes longer depending on how fast the court wants to proceed.

A sheriff will have to come out and serve the buyer with foreclosure notices and remove them from the property.

If possible try to work something out with them since it's gonna be a lengthy process to foreclose on them.

land contract deed

Your question quite has the answer in it. The period that you have to wait before you can evict a person depends on the terms of the contract that parties to the contract have agreed upon.

Any land contract will also include the payment date and the other terms and conditions that the parties have to abide by. In that case, if the person fails to honor his commitment with the said period, the victim can always evict the person.

Once the dare falls due, you are good to evict the other person.

However, it is your personal choice to extend the process of eviction if you choose to or based on the promise of the other party that he will honor his committed on the extended date. It is again better that you get it in terms of writing or you better evict the person.
