Can my insurance company sue an uninsured driver?

I got into a wreck yesterday and I was insured but the driver that hit me was uninsured?

Can the insurance company sue the uninsured driver for having no auto insurance?

I don't think your insurance company would sue the other driver for having no insurance but you could likely take the other driver to court and sue them for the damages to your car.

Your insurance policy should also cover you for the uninsured drivers accident causing damage to your car.
